Celebrity Legal Woes: Why Kang Dong-won and CL Avoided Prosecution

[Sports Today reporter Jeong Ye-won] Prosecutors have decided not to pursue charges against several celebrities who were referred for operating unregistered one-person agencies.

On the 25th, Sports Kyunghyang reported that the Namyangju branch of the Gyeonggi Uijeongbu District Prosecutors’ Office and the Seoul Western District Prosecutors’ Office issued suspended prosecutions in unregistered one-person agency cases involving actor Kang Dong-won, singer CL and Ok Joo-hyun. The Seoul Central District Prosecutors’ Office likewise issued a suspended prosecution for Jo (surname), the older brother of singer Song Ga-in and the head of her agency. The referrals stemmed from suspected violations of the Act on the Development of the Popular Culture and Arts Industry.

A suspended prosecution means prosecutors decline to file formal charges against a person who is believed to have committed an offense. Under Article 247 of the Criminal Procedure Act, prosecutors may exercise discretionary non-prosecution.

Last year, a number of entertainers — including Sung Si-kyung, Hwang Jung-eum, Yoo Ah-in, Lee Ha-nee and Lee Hi — were embroiled in controversy over unregistered agencies. Under the Act on the Development of the Popular Culture and Arts Industry, entertainers operating as corporations or as sole proprietors beyond a certain scale must register as popular culture and arts planning businesses. Violators face up to two years in prison or fines of up to 20 million KRW (approximately 15,000 USD). The Ministry of Culture, Sports and Tourism ran a registration guidance period for the industry through Dec. 31 of last year.
