Allegations of Misusing Anti-Election Fraud Group for Campaign
Hwang Kyo-ahn Bristles at ‘Defendant’ Title

Former Prime Minister Hwang Kyo-ahn, indicted for allegedly campaigning through his “Anti-Election Fraud and Corruption Group,” vehemently denied all charges in his first court appearance.

The 31st Criminal Division of the Seoul Central District Court, presided over by Judge Park Jun-seok, commenced the initial hearing on Hwang’s alleged violation of the Public Official Election Act on the morning of the 10th.

Hwang’s defense team argued that the search and seizure during the investigation were conducted illegally, rendering the subsequent indictment invalid and grounds for dismissal. They maintained Hwang’s innocence and promised to submit a written opinion addressing numerous factual errors in the indictment.

The court acknowledged receiving the opinion on the search and seizure issues but clarified that these concerns relate to evidence admissibility and do not constitute grounds for case dismissal.

During the hearing, Hwang personally raised objections to the court’s manner of addressing him.

“Being called ‘Defendant Hwang Kyo-ahn’ makes me feel like a convicted criminal,” Hwang protested. “It would be more appropriate to use ‘Defendant Representative Hwang Kyo-ahn’ to acknowledge my position. The current practice makes me feel trapped in court. I understand it’s tradition, but it needs to change.”

The court responded, “As you know, this is standard practice for everyone,” but added, “We will consider the concerns you’ve raised.”

Hwang is accused of attempting to influence last year’s presidential election by using his Anti-Election Fraud group to promote his achievements and campaign promises while running as a candidate.

Current election laws prohibit establishing organizations for campaign activities outside of official campaign offices and contact points. Violations can result in up to three years in prison or fines up to 6 million KRW (approximately $4,500).

The court has scheduled the second hearing for the 11th of next month as the trial continues.
