Mental Health vs. Family Conflict: How a 20-Year-Old’s Attempted Murder Case Highlights the Need for Better Treatment Options

A man in his twenties who stabbed his father during a dispute over mental health treatment has received a prison sentence in the appeals court.

The Third Criminal Division of the Daejeon High Court, presided over by Chief Judge Kim Byeong-sik, upheld the original five-year prison sentence for Mr. A on February 10.

However, the court overturned the lower court’s order for a ten-year electronic monitoring device requirement, instead imposing five years of probation.

Mr. A was tried for attempting to murder his father by stabbing him in the abdomen at their home last February.

Investigators found that Mr. A, who suffered from depression and sleep disorders, had sought hospitalization for electroconvulsive therapy but committed the act after his father refused to give consent.

The lower court noted that the defendant was about 18 years old at the time of the crime and fortunately did not succeed in his attempt. They also considered that the victim expressed a desire for leniency and did not wish to punish the defendant. The court suggested that the defendant, who had experienced mental illness since childhood, may have committed the act due to an obsession with the necessity of treatment, leading to the five-year sentence.

The appeals court stated that the victim has repeatedly indicated he does not wish to punish the defendant, and family and friends are pleading for leniency. They concluded that the probation order, which mandates mental health treatment, should be sufficient to prevent recidivism, accepting the defendant’s argument that the electronic monitoring device requirement is unjustified.

Additionally, they remarked that while the defendant appeared to have limited capacity to discern or make decisions at the time of the crime, the lower court’s decision not to consider this as a mitigating factor was valid.
