[Sports Today reporter Kim Tae-hyung] YouTuber Gujaeyeok, whose three-year prison sentence for extorting money from fellow YouTuber Tzuyang was upheld, announced he will seek a judicial review.
On the 16th, Kim So-yeon, the attorney representing Gujaeyeok from the law firm Hwang & C, said in an official statement that the Supreme Court’s decision in the Lee Jun-hee case, released today, includes the following language: \”When the reasoning of the trial court’s decision is examined in light of the relevant legal principles and the properly admitted evidence, some parts of the lower court’s statements are somewhat inappropriate.\”
She said that by describing the lower court’s decision as \”inappropriate,\” the Supreme Court has effectively acknowledged that the trial court’s logical basis or its explanation for convicting Lee Jun-hee contained legal defects or unfairness. The Supreme Court, she argued, should have further identified what legal flaws existed in the passages it found inappropriate and explained how those flaws led to shortcomings in the administration of justice.
She criticized the court for dismissing the appeal as filed despite those \”partially inappropriate\” passages, saying they could amount to serious defects that affect Lee Jun-hee’s right to livelihood.
Attorney Kim added that while the judiciary’s decisions deserve respect, correcting an improper legal basis is also a duty of the rule of law. The state’s exercise of criminal power must not tolerate even the smallest impropriety. Defendant Lee Jun-hee intends to file a judicial review petition to challenge how the Supreme Court’s acknowledged \”inappropriate parts\” infringed his fundamental rights.
She also said that Lee Jun-hee received the appellate decision today and is preparing the judicial review petition. The defense will provide further updates after the petition is filed. She asked the public to pay attention so that any distortions caused by media maneuvers or public agitation can be corrected and the truth revealed.
Meanwhile, the judicial review petition system, which allows constitutional complaints against court rulings, went into effect on the 12th. According to the Constitutional Court, 44 judicial review petitions had been filed within four days of the system’s launch.
